Auto Insurance Claims: Underinsured claims when death occured, uninsured motorist coverage, brother death

My Husbands identical twin was killed on his motorcycle 3 weeks ago by an 18yr old who accidently pulled out in front of him (sun was behind my brother in law and he did not see him) The family does not have any assets and the drivers insurance has agreed to pay the max 100K. I was told that this is all we can expect to get from that end for my brother death. I am looking at my brother in laws motorcycle coverage with State Farm and it shows 100/300 for bodily insury and U3 Uninsured motor vehicle Bodily Injury 50k/100k. Can we seek a claim with his own insurance company since he was a single father who has left 3 young girls at home. We are trying to find as much money for the girls and set up a trust for them. He has left a lot of debt as well. Do we need to hire an attorney to seek max insurance claims or can we do it ourselves?

I'm very sory for your loss.

If your brother-in-law's policy has uninsured motorist coverage on it, you should be able to make a claim. You should contact state farm and tell them that you want to file an uninsured motorist claim. You will need to tell them about the other insurance and ask them to tell you the exact procedures you need to file to make the claim for the full policy limit of both policies. Make them put it in writing because any phone conversation can later be denied. If they do not seem to be treating you fairly you should seek an attorney.
