Auto Insurance Claims: Is there a CA law on the amount of time and Insurance Company has to pay you?, insurance comapny, own insurance

5 weeks ago my car was parked on the street. A lady reversed into my car. She admitted it was her fault to the insurance company. The insurance company has said that since the car was insured by someone else that they are only the secondary on the claim and I have to check with the primary. They just told me this last week and I have been driving a damaged car for 5 weeks. Is there some law that forces the insurance company of the driver to cover all up front costs until the primary can come in and reimburse them. My vehicle was hit and I had nothing to do with it yet I have to drive around in the damaged car for weeks.

Hi Solomon,

You need to place the claim with the insurance company of the vehicle owner.  If the driver of the car is not the vehicle owner, their insurance will not pay anything unless the amount of damage exceeds the amount of coverage under the vehicle owners policy.

You need to find out the insurance information of the vehicle owner and make your claim to them. Or you can put the claim through your own insurance comapny and your insurance company will seek reimbursement from the vehicle owners company.
