Auto Insurance Claims: insurance claim, leinholder, own insurance

Question
I rear ended someone the problem is i am not the owner of the car but am the lein-holder on the registration i had my own insurance at the time because i took the car back. I did not have an insurance card with me at the time. the owner of the car also had insurance on the car. Which insurance should pay the damage to the other car. I think it should be mine since i was driving but the other persons ins filed the claim to the owners ins company it happened in arizona

Answer
Hi Kris,

Although you were driving the car, in most states the insurance follows the vehicle, not the driver. So it would likely be the owners insurance that would pay the claim. However, du to the fact that you are the leinholder and had repossesed the vehicle, there may be a catch that I'm not aware of in your state.

I hope this helps
