Auto Insurance Claims: rear-ended, jeep grand cherokee, collision damage waiver

My daughter, a Mass resident, was rear-ended in Rhode Island by a man, also a Mass resident, who drove a company car. Her car, a 1995 Jeep Grand Cherokee is insured, but not insured for collision damage. The insurance company for the other driver (Sedgwick CMS) is covering repairs and a rental car, but refuses to pick up the fee for the collision damage waiver (CDW) on the rental car. They say they have never done that and "It's just our policy".  My daughters insurance company will not cover the rental car either, because she did not have collision coverage at the time of the accident.  Although, they do say that if the situation had been reversed, they would pick up the fee for the CDW.

Who should cover the cost of the CDW?  The original driver that hit my daughter? The company he works for (Georgia Pacific)? Sedgwick CMS? or my daughter?

Hi Ted,

In my experience the insurance company never pays for CDW. But I would at least argue with them to try. I would also send a certified letter to the drivers company and and demand reimbursement from them.
