Auto Insurance Claims: auto accident, state insurance commissioners, isuzu trooper

I was involved in a vehicle accident on Oct 18, 2006 a week ago. The other driver failed to yield the right of way to me. She was given a ticket by a police officer and considered at fault. Her insurance agent is giving me the run around or at least it feels that way. I gave my statement to her agent, who then called her for her statement. They called me back today Wedn. 10-25 and said they had not accepted liability yet that the 84 year old lady said I had my blinker on and was on my cell phone which are both lies. There were two witnesses who saw it all. I feel that the agent is giving me the run around. How long do they have to give me a decision, before I take other actions. I have rented a vehicle and paying for it on my own. I know I will end up on the loosing end because her vehicle was and 2003 Cadillac and my vehicle is an 94 Isuzu trooper which was in great condition with the original paint and body. The estimate to fix it is 4700, all I want is a response from them so I can move forward. Her vehicle has been fixed I don't know if by her insurance or on her own I don't want to take any other actions at all I thank God we were both ok. All I want is my trooper fixed or an answer, how long do I have to wait? Am I over-reacting?

Hi Mary Jo,

Unfortunately, in most states, the insurance company has up to 30 days to either pay or deny a claim. If you have collision coverage on your own policy, you can put the claim their. Otherwise you do just have to wait.  If it takes too much longer, you could also file a complaint with your state insurance commissioners office.
