I currently own a vehicle but my daughter drives it and has her insurance on it.She had an accident and it is in the shop getting repaired.If i want to take the vehicle back from her will i be responsible for paying her $500 deductible to her insurance company?

Hi Tim,

No you will not be responsible for paying the deductible to the insurance company.  The insurance company will issue a check for the repairs equal to the cost of repairs less the deductible. The deductible will have to be paid to the body shop when the vehicle is picked up, regardless of who has possession of the vehicle.

The Repair shop is going to return the vehicle to her insurance company when work is completed.Now can they refuse to turn car over to me unless i pay the $500?

Hi Tim,

Unfortunately, the deductible will have to be paid before the vehicle will be released. I am not familiar with the shop returning a vehicle to an insurance company, but if that is the case, then yes the deductible will be paid to the insurance company.  But that is very unusual.
