Auto Insurance Claims: Log in road., police incident report, stationary object

I recently hit a cut log on a winding one lane road. It was at night and no street lights present.  A police officer traveling 100 yards behind me also was unable to avoid it and hit the same log.  The log cracked my rim, damaged my bummer and popped my tire.  My insurance company is claiming this is my fault and I am responosible for the deductible (i have broad-form collision).  They claim I should know the hazards on the road and adjust my driving accordingly.  A police incident report was made stating the accident details.  I believe I should not be liable for the deductable.  Am I right in this assumption?  Also, why does this not fall under comprehensive coverage similar to hitting an animal in the road?

Hi Alex,

Unfortunately, this is one you will not win. A log in the road is a stationary object. The insurance company is right. You should have been able to see the log in your head lights and stop or go around. Your deductible is contractual and will have to be paid.
