Auto Insurance Claims: 3 car pile up, mazda protege, dodge dakota

I recently was invloved in an accident with my car (Mazda protege) inbetween a Dodge dakota (in front) and an acura behind me. While the pickup and my car were stopped, the acura hit me from behind as a result of which my car rolled and rear-ended the pickup in the front. My car sustained significant damages in the front while the other two vehicles sustained no damages (a few scratches).

The police report regarding accident also records the same facts. However my insurance agent called me and told that the car driver of the acra is not accepting responsibility. I was under the impression that the case was clear cut and the entire fault was with the car behind me. I was wondering if you suggest me my options now.

Hi Harish,

If as you say, you were completely stopped and were hit from the rear, then there is no question that the other person is a fault.

You should protest vigorously with your insurance company.  Demand that they do a complete investigation.  If there were any witnesses to the collision, they should be contacted by your insurance company for a recorded statement.  If the at fault driver was issued a citation, that should also help.  If these things do not result in a finding of fault against the other person, then you will have to file a law suit against them and let a judge decide.
