Auto Insurance Claims: loss of use, hi tim, repair estimate


Question
besides the $15 per day, do they owe for the differance in cost of gas for mileage, since what I drove only got 12 miles per gallon?

My motorcycle was struck by a hit and run driver.  The police found him a week later.  The repair estimate was settle but it took 6 weeks to get the parts in from Harley Davidson to fix.  The bike was not ridden untill it was fixwed.  What is the insurance company liable to pay for loss of use.  From the time it was struck til it was fixed was 56 days.  Do they have to pay me for a rental for each day, whether or not I used a rental?  Do they have to pay my out of pocket expense ie gas, towing ect.  I live in  California.

HI Tim,

The insurance company owes you for either a rental car if you actually rented a car, or loss of use. Loss of use instead of a rental car is generally paid at $10.00 to $15.00 per day.  I would start asking for $15.00 per day, then negotiate a reasonable settlement.

Hi Tim,

Although you could make an argument that they do owe you that, it is unlikely they will even consider it.  The only way you might collect it is by suing the at fault person.  If the judge decides that they owe it then the insurance company will have to pay it.

Unfortunately, the amount of money your talking about is likely not enough to make going to court worth while. Sometimes you just have to take what you can get.
