Auto Insurance Claims: How long do I have to make a decision on a auto claim, tow yard, storage charges

My vehicle was involved in an accident, no fault of mine.  The other parties insurance company has made me an offer they have stated my car as a total loss.  This is an older vehicle 1986 chey celebrity that was in very good condition and they sent an adjuster out and he said there was 1684.00 in damages, however they have only offered me 1,139.50 and I must turn the car over to them or they will salvage the title and give me much less. I have not been able to find a replacement vehicle and my car is still drivable.  How long do I have to make a decision on accepting an offer from them they it has been about six weeks and they just sent me a letter stating that if they do not hear from me within 15 days they will close the case.  I thought I had up to one year to make a decision.

You are right you have I believe one to two years on a Property damage claim to file your claim.  I would recommend that you get the valuation report from the other carrier and look through it thoroughly to make sure mileaage and options are correct as these can make a big difference in value.  The other party should be able to fax or send it to you.  The only other thing is if your vehicle is in a tow yard the other carrier will only pay reasonable storage charges and soon will make you pay them if they haven't already.  If the vehicle is located at your residence or another storage free location, then you can take all the time you need to negotiate the claim.  I send letters out all the time telling people I am closing the claim but it is just a way to get you to settle quicker.  All claims can be re-opened within the year to two years you have.  Also if you can find comparable vehicles to yours that are selling in your area for more then you are being offered submit them to the other carrier and you may end up with a better offer.  Just some tips to help you.  Let me know if I can further assist.
