Anwsers to your questions.  My Total medical bills were $1,827.16.  Work hours missed were 44 hours, total $627.00.  I was treated for 2 1/2 weeks.  Previous back problem pulled a muscle between my shoulders about 10 years ago.  Accident occured in Iowa which I believe is not a no-fault state.  Not being treated by medical professionals now, still doing exercises at home to keep my lower back from getting tight, when I was in physical therapy they said it was my hip and tailbone that were out of place.  Do not feel I am at pre-loss status, seem to have to stay with the exercises to keep my lower back from hurting.  don't feel like I need to see a professional now, but I am worried about later on.-------------------------

March 23, 2005 in Iowa, I was stopped at a stop light and was rear ended and shoved into the car in front of me.  My car was totaled.  The girl that rear ended me was given a citation - she was responsible for my car and the car mine hit.  My medical bills and my car have been paid for by this insurance company.  I was off work for three full days and 3 -  1/2 days, I went through physical therapy, friends had to come and clean my house - I seem to be doing ok now but I'm worried I will have future problems.  The insurance company wants to compensate me $600.00, I told them I want $3,000.00, then they came up to a $1,000.00.  Does it sound like I'm out of line.  I have never had lower back problems before this.

What were your total medical bills?

How long did you treat and with what type of medical providers (ER, MD, Chiro, Phy Therapy, Specialist, etc)?

Have you ever had problem(s) with you back prior to this incident?

What State did the accident occur in?

If that State a No-Fault state?

Are you still treatingt for your injury(ies)?

Have you recovered to your pre-loss status or do you have any residual(s) from accident?

Advise the date of loss and when you first treated and when you last treated.

Confirm for me that the at-fault carrier has paid your medical... and further what we are talking about re settlement dollars is above and beyond the medicals and lost wages and therefore "new money".

Assuming that they reimburse you for your net lost earnings.. I would value this claim (new money) in the $1,600-2,000 range.

That is right in the middle of where you presently are $3,000 demand and $1,000 offer.

Appears some negotiations are in order..

Suggest you tell the adjuster for starters that your back is STILL bothering you and you are THINKING about going back to the MD... then say you would like to settle this matter NOW rather than LATER and provide the rep with a COUNTER-demand in the amount of $2,500 and invite him to give you a counter-offer....

If he moves up to say $1,250-1,500 then provide another counter in the $2,220- 2,300 range and then keep moving towards your target of $1,600-2,000.

Once you have presented your 1st counter do NOT present another counter UNTIL you have a counter from the rep.... you will move again when he moves.... it's a game.

Keep in mind that while you may get a somewhat higher number with an attorney that the attorney will take 1/3 or so of your gross... always think NET.....
