Auto Insurance Claims: ins paid us now company out of business, personal obligation, insurance fraud

A customer brought his motorcycle to my shop in Maryland for repair, the insurance company paid his claim directly to the business. This repair was a major tear down repair. The motorcycle is basically in pieces at this point. My business closed down as of yesterday. I have all the parts to put it back together but not a place to do it, what should i do, what is my responsibility, and is this insurance fraud??? I have no way to complete the job at hand, i dont want to get into any further trouble but my company doesnt have a dime?? Any information you can give me is much appreciated.

Hi Kathy,

This is not insurance fraud. If your business is incorporated and it is filing for bankruptcy, you should have no personal obligation other than the return of the bike and all of the parts to its rightful owner. Perhaps you could contact another bike shop in your area to see what help you could provide to get the bike somewhere it can be repaired.

If you were not incorporated then you will be personally liable for the costs. If you don't have any money or assets then there is nothing they can get other than a judgement against you. You may want to speak to an attorney.
