Auto Insurance Claims: Valid Insurance Policy, claims advice, accident liability

I was a passenger in a car accident.  I was in a car verses a big rig truck.  I suffered significant injuries in the accident.  I have been trying to find out if the driver of the truck had a valid insurance policy during the time of the accident.  The police report stated the truck driver had an Accord Auto Insurance policy only.  No address or phone number was listed for the insurance company.  How can I find out if this policy is valid?

You don't mention who was at fault in the accident.  If the truck was at fault, then you would need to file through the owner's liability coverage.  If the driver of your vehicle was at fault, you would file through his liability coverage as a passenger.

I will assume from your description that the truck was at fault.  I did a quick search on Accord, and it appears that this is not an insurance company, but is an agent that would have sold the policy on behalf of the insurance company.  Since you must have the name of owner of the truck on the police report, you could call the agent to see if they will provide the insurance company for that owner.  I can't say they will necessarily help you, but you can try.


The other alternative is to contact your Ca Department of Insurance.  Most insurance departments will provide carrier information.  You can call them at 1-800-927-HELP (4357)and ask what the procedures are for finding the name of the insurance carrier of the owner of the truck.

If you have significant, permanent injuries, you should also consider hiring a personal injury attorney.  In that case, the attorney would find the insurance carrier.  And there could be two carriers - one for the tractor and one for the trailer.
