Auto body repair & detailing: 2002 Nissan Maxima FL, Left side accident, nissan maxima, side mirror

I was involved in an auto accident on Jan-17-2007.  I was turning left and entered a center turn lane.  I was about to glance in my left side mirror to merge into traffic when I was hit by another vehicle.  I have damage to my front left headlamp, both front and rear left doors, and a dent above my rear left wheel well.  I forgot to pay my auto insurance in Dec-2006 and it was cancelled.  Now the other driver's insurance is listing me at fault.

Is there anything I can do to help make a case against the other driver to show he was at fault?

Also, how easily can I pull out that dent myself?  And should I be worried about the rust that is forming?  I do believe Nissan uses a anti-corrosion paint on both sides of the body metal.

Usually in a case such as this where there is disputed liability people will go through their own companies to handle the repairs and then let the insurers fight it out in subrogation. In this case the only thing I can recommend is getting legal advice. Are there any police reports in your favor? Was the other driver cited at the scene? Did you get photos or witnesses at the scene? I believe it is going to be a near impossibility to fight the other insurer on liability without something to prove their was at fault. As far as the damage to the car- it is too difficult for me without being able to actually see the damage. Rely on a quality shop for good advice on that one. Good Luck- Mark
