MG Car Repair: gearbox change, gearbox oil, correct oil

QUESTION: hi there. recently my gearbox broke so i brought it to a mechanic with a second hand gearbox and a new clutch. i asked him to install this cause i dident no how to. he installed this and i payed him.two weeks later the gearbox broke. i brought it to another machanic and he told me thatwas no oil or grease put in. should this of being done by the first mechanic. thanks

ANSWER: Unfortunately, this is a legal question rather than a technical one, and I do not claim to be a legal expert.  I recommend that you get a second opinion from one of the legal team at AllExperts.

I guess it depends where the work was done.  If you got a mechanic to swap the gearbox in your garage, then he might argue that he did what you asked and it was your responsibility to fill the gearbox with oil before you drove the car.

If you had the work done at a professional garage, then it was their responsibility to fill the gearbox with the correct quantity of the correct oil before the car was driven away from their premises.  

Did you get a receipt for the work, and were you billed for any gearbox oil?

QUESTION: hi there. no i didn't get a recpite for the work but he agrees that the work done was there.

Like I said before, if he did the work at his premises, then he should have filled the gearbox with the correct quantity of the correct oil.  I am not a legal expert, but in my opinion you could reasonably expect the car to be handed over to you with a gearbox full of oil, all ready to go.  You should go back to the mechanic who did the job and tell him that you expect him to fix it at no additional cost to you.
