Motorcycle Repair: 4th gear noise, gear noise, fluid changes

Mike.. I hope you can help. My 05' road king makes a distinct and annoying Whirring/singing noise in 4th gear at operating temp. It gets louder as temps get hotter. I've had it in the local dealership twice, and they say they don't hear anything wrong. We've done fluid changes and primary and belt adjustments to no avail. The noise is barely audible in 3rd, loud {to me and a passenger} in 4th, and non existent in 5th. I contacted h-d prior to the expiration of my warranty, and did receive a ref.#. With only 5k and gentle riding I am sure there is something bad in the tranny. I strongly believe I'm getting jerked around by the dealership. It's the only one for 200 miles. Help! The whinning is probably the way the gears are meashing. Sounds like the gears are too loose between them. If this is the case it wount hurt anything, just a pain. I would contact harley again and tell them you want it resolved or a new trans
