Motorcycle Repair: Fatboy Choke, factory warranty, trouble code

I just bought a 2005 fatboy and can't find the choke anywhere on it. I'm used to riding older harleys and know nothing about the new engines. It sputters and backfires when it's warmed up so I'm assuming it's the choke.

The choke is on the left side under the gas tank next to the petcock. Fuel-injected bikes have no choke. They are all computer controlled. If you have no fuel petcock your bike is fuel-injected. If the production date on the sticker on the front frame downtube is 12/04 or later, you are still covered under factory warranty even if you didn/t buy it new. The bike should not sputter at any rpm. If the engine light stays on for six seconds after the bike starts you have a trouble code in the memory.
