Towing Issues: car towed from condo, license plate numbers, nissan altima

My car was towed from my condo complex this am at 3. We have parking permits and mine was clearly visible. When we first called the tow yard they sd they had it and then proceeded to tell us we cant get it till 2. This upset me a lil. So then we called back and they sd they cant tell us if they have the car or not. I told them I was going to call the police because they wont tell me. They called me back and sd they didnt have my car (05 White Nissan Altima) they had A White Sentra. We called the cops. They cops called and were told they dont have my car. When the cops began the police report something popped up in their system that showed the tow company did in fact have my car and had had it since 2:40am. They cop called them again and was then told oh yes we have the car the owner told us it was a Sentra not an Altima.
There was no reason that I can see to 1 tow my car or 2 give so much wrong info.
Is there aything I can do about this.

First of all, I hate to say it but at times, mistakes happen and your vehicle might have been towed by mistake if you were parked legally in a valid space which was not reserved for someone else. And if the permit was visible then you should not have been towed. (that's my thoughts, but then I was not there and do not know what caused it to be towed#

Now as to the problem with the vehicle being listed wrong, it does happen as sometimes the driver does not read things but guesses at the make and model. And a lot of vehicles in tow yards are listed and filed via the license plate numbers, which unfortunately most customers #car owners# do not know.

Now as to not being able to get the vehicle till 2, that is strange as California does have great laws regarding towing vehicles, how to notify the authorities, and redemption procedures.
It sounds like they might be playing a bit to get more storage charges. But that is a guess again on my part.

As to what to do, well you always have the rights to take this to small claims court and let a judge decide if you were wronged.
If your documentation is correct and you have proof #pictures and stuff) of the vehicle parked legally and displaying the permit, you might have a case. BUT REMEMBER that the same laws which regulate the towing, also require the tow company to take pictures of the vehicle showing the violation. That might be hard to beat if they did it right.
