Towing Issues: Towing Car, small claims court, home signs


Question
I live in Riverside CA and I was recently towed. I reviewed
the VC 22658 and I am still confused. My car was towed in
the visitors parking, I was with a resident of that apartment complex. There was no signs visible, at the
moment, at that time I say because the gates were opened and
as you go in the signs are not visible, and I parked in
visitors which said nothing about being towed. I was there
at the complex for about half an hour (1:40 am I parked) I
came back to get my car and it was not there (2:15am). I
just checked the receipt from the towing company and they
had towed me at 2:00am. What I am wondering is if I can file
a Smalls Claims stating that the signs were not visible,
that I was in visitors parking, and that either ways I could
not get some sort of permit because the office was closed? I
was also left in the Eastside of Riverside which has high
crime and my passenger and I had to walk home.

Signs do not need to be posted in each and every space, and they should of been at the entrance to the complex visible as you drive in.

As to visitors space, I really have no idea as you are correct about the office being closed and no way to get a permit from the office. But the tenants might have some kind of permit - pass which they use for their visitors. Each policy is different.

As to small claims court, you always have that right, and if you decide to go that route, remember that you will have to present information which proves you were wronged, and that others made a mistake.

Good luck on the trying to get something for being in a bad area and having to walk home as that will be just a "tough luck" kind of thing I think is what the judge will say.
