Towing Issues: Retrieving a towed car registered n deceased Fathers name?, maximum tariff, deceased fathers

Is it lawful for a tow service to refuse the retrieval of a towed and stored vehicle because the registration is not in your name? I have been driving my deceased Fathers car for over a year, however, I did not have the vehicle registration changed. I live in Georgia and am being told that if the registration is not in my name, I cannot get the car nor my personal belongings in the car. The car was towed as a result of a arrest for a traffic violation. Please help. Thanks you in advance for your site and prompt response.Time is running and the cost is increasing.

Well if this happened in Georgia, there are rules and regulations which govern tow companies.

Now that tends to cover vehicles which are towed from private property, but the information is basically the same. The tow company is protecting the owner of the vehicle and its contents. They have the liability when the vehicle is in their custody.

Now the police department might have some contract rules which also apply in tows for driver arrests.

Now in the second link there is a section entitled "maximum tariff rates" which allow to towing from Private property.
Police towing rates tend to vary state wide due to rules and regulations and as such they do not always appear online.

Now as to establishing that you own the vehicle, I would assume that the will and other legal papers gave you the vehicle. If so then you might be able to get it out with that documentation, but it would be best to get it registered in your name.
