Towing Issues: Towing and storage fees, state insurance commissioner, small claims court

Car was totaled in a accident (other's fault) was towed to a yard then to shop for apprsal. it was totaled by insurance company. we did not agree for 4 months on settlement. found out it accrued storage fees, but was not notified by the shop at any time it was still there. when storage over 30 days do they the shop have to notify you that the cars is still there? and is towing usaually covered by the insurance company?

When a vehicle goes to the body shop there are sometimes different rules about storage and the lien process.

And notification is generally considered when you are asked if it can be towed to the body shop or you tell them to take it there.

It sounds like your insurance company (or even the other peoples) has dropped the ball and forgot about the vehicle. It happens a lot.

Yes the insurance company is supposed to handle towing and storage fees and I really hate to say it, but they try to pass off as much of the expenses to the vehicle owner so they can keep more of the money you give them in premiums.

If you have the right coverage (full coverage) then you should be all right and they should handle it all. But remember that they tend to bluff you with "its part your fault" and all that.

If needed you might talk to an attorney who is not involved in this as they might offer an idea or something for you to do.

Worst case is if it really gets bad on them trying to pass of the bill to you, you might have to go to small claims court about it, or even contact the state insurance commissioner about what they are trying to do.
