Towing Issues: Car Towed Out of A Ditch, dubois indiana, tow rates

Question
After I was run off the road by an oncoming truck, my car landed in a ditch. The police officer called a wrecker service to get my car out. He pulled my car out of the ditch to a flat surface, about 10 yards. Even though my car was drive available, the tow truck driver took my car to his lot. I could not drive my car home unless I paid him $125 cash. It happened after his business was closed and in Dubois, Indiana. Can he order $125 cash only? And where can I find the maximum tow rate for the state of Indiana?

Answer
what are the maximum tow rates????

Well as far as I know the state of Indiana does not regulate tow rates, but then again there might be a local contact rate with the police department and tow company which will not be easy to find.

Now in regards to rates, I hate to say this but a tow company is a private business and as such can set its own rates in order to make a profit and cover expenses.

Now cash only, that tends to be a normal method in towing, due to the fact that many towers tend to deal with vehicles and owners who really do not want to be towed and as such do not want to pay the fees. And as such towers tend to have a lot of "STOP PAYMENT CHECKS" and "DISPUTED CHARGES" on debit and credit cards.

Now I also have to say that $125.00 was not unreasonable for the winching and recovery of the vehicle and towing it to his yard. But I bet there will be storage charges for the vehicle to be in the tow yard. These are charged on a daily basis.

Hope this helps, but there is not much I can offer for more advise. If you really feel wronged you can try the small claims court route.
