Towing Issues: car towed from my carport, small claims court, tow company

So my fiance woke up this morning at 4am to got work to find that our car had been towed out of our carport that was assigned to us by our managers.When we called to find out why our car was towed they told us we did not have our permit sticker on our car & that security ha tagged it all month. As far as i know i had placed my sticker on my window a month prior & received nothing from security or my managers stating my sticker had been missing.
Plus i have my car registered w/ the apartments that my car is the one to be parked in my carport. So my question is "Is it legall to tow someones car out of their carport they pay for which is registered w/ the apartments for not having a sticker?  I am from Fresno ,Ca.

well basic answer here is "yes it is legal to tow if you do not have the required sticker"

You mentioned that at 4am you found out it was towed, I am guessing that it was towed sometime between 5pm (when the office closed) and when you found it gone.

Registered with the office does not help much, as if the office is closed how does someone find out if it was legal or not.

Now as to the "Notices" you mentioned, I really have no idea what that what about. A sticker on the window?

Was it just a sticky note which can blow off?
Was it a big hard to remove, warning sticker which most complexes use?

There are lots of methods of warning, and while you say you never say one, I was not there and do not know what they use. You might have a talk with the office and see what kind of warnings and if they have copies of them on file.

Now as to your other rights, well you do have the option of going to small claims court over this and you will need lots of evidence.

The tow company is supposed to take pictures of the vehicle showing the violation, and that will be useful in court.

Any other documents and such will help including rental agreement, proof of parking permit issued to you and the like.

Now where is the permit, I guess you paid and got the vehicle back. Did you find your permit ANYWHERE in it???

Was the permit in the vehicle but it fell down off the mirror or window making it hard to see from a distance. Nothing says that the tow ocmpany or security has to search your vehicle for the permit if it is to be in a certain spot. And when they fall down they can land face down or behind something and that is hard to see or find. Specially from outside a locked vehicle in the dark.

Do you have the permit in the apartment ?  

Those are all questions that have to be answered before you decide to take action via the courts.
