Towing Issues: vehicle towed, dmv web, murrieta ca

Question
Hi,
We live in Murrieta, CA and my sister left her vehicle with us about 3 weeks ago because she went to Canada for vacation and we had it parked in front of our house on the street and it was towed this morning. There are no signs posted saying we cannot park but I found out this morning that it is illegal to have it parked on the street for more than 72 hours. The officer who got it towed said he marked the tire of the car and since it wasnt moved it got towed. My question is shouldn't the officer have left a warning ticket stating either move it or it will be towed? Otherwise how would we have known it was illegal to park for more than 72 hours. Thanks!

Answer
Well I got to say that in most cities they have the 72 hour rule regarding parking on the street.

The rule is so that vehicles are not abandoned on the streets. Those rules are usually found in the City Codes, and some are also state laws. I believe that California has it as a state law in addition to other cities.

Now as to the warning ticket they might of put a ticket on it, but it could of blown off, or been removed when it was towed and not given to you. I am assuming that you did pick up the vehicle already, or your sister did.

California DMV web site has a ton of regulations regarding towing vehicles either from private property or as ordered by police officers.  You can check out the rules and see if you can find any things which might help you understand what happened or to possibly fight the towing. Yes you do have rights to a hearing.

I would try to provide the answers, but you know all the answers and what applies and I would just be guessing on them.
