Towing Issues: Towing due to HOA in Harris County, Texas, single family houses, harris county texas

Okay my HOA passed a new ordnance saying that illegally parked cars (on sidewalk, on street) will be towed. I have no problem with this. Then the letter went on to say that if your vehicle in your driveway has an out of date sticker (registration or inspection) they will come on to your property (single family houses) and sticker your car and if the "violation" isn't corrected within 24 hours they will tow your car away from your home. Again they are talking about a vehicle legally parked in my driveway - not on the street. Furthermore they went on to say that if a vehicle "appeared" to be inoperable they would tow it away, from your driveway.

Is this something they have the power to do? This was not a deed restriction when I bought the house. Can they legally come on to my property and just take my vehicle?

I really wish that I had real solid answers for you, but when dealing with a HOA you have additional rules which they can make up at will. Now if they say that no blue cars on Tuesday then its the rule.

But most HOA's tend to make rules for "QUALITY OF LIFE" or appearance type things. So if the vehicle is inoperative or has expired stickers then they can tow it if they follow the state laws regarding notification. That is what the biggest issue will be.
