Towing Issues: Towing when paid to park, puc office, small claims court


Question
We went to dinner in Downtown Oklahoma City and paid to park in a lot.  When we finished our dinner and came out our car had been towed.  When we inquired to the man at the pay booth at the front of the lot we were told we parked in the wrong spot, a spot reserved for the manager.  There were no signs posted and no way of knowing that it was a spot not available to park in.  The lot attendant said that there were cones placed there but that they had trouble with people kicking them over and moving them, none of which I did.  Now I have to pay to get my car back and the towing service that clearly on the sign states 24 hour towing says I can't get it back till after 9am the next day.  What are my rights as far as getting back the expense I am going to be out in retrieving my car and what are my rights since I paid to park in the spot.  I live in Oklahoma City, OK.  I would appreciate your input.

Well if the space is not really marked very well then you might have a great small claims court case. But cones do not really mean much and that will be what the judge could rule.

Now if this lot is attended and the attendant did not say anything about parking where you did if it was reserved for the manager (was it next to the machines or booth) they should of said something.

Keep your receipts, go back if possible and get pictures of "EVERY SIGN" and take lots of pictures of the parking lot and space in question. If you go to small claims court you will need lots of evidence to get the judge to rule in your favor.

Now in some places and I am not sure about OKC, they have rules and regulations regarding towing vehicles from private property. I can not really find much about Oklahoma online for that.
But I know that towing is regulated by the Oklahoma PUC office (or something like that) and as such the rates are also set by the state.
