Towing Issues: sign hard to find, tow driver, towing companies

I went to my sisters apartment to sleep around 1am. when i wake up my car is gone. So i look around the building to find a sign that states 'unauthorized vehicles would be towed' and finally i see it partially hidden behind bushes. So i was wondering who would should i take to small claims since the sign wasnt in clear view? Also are towing companies allowed to enter your car without a policemen present?

Well as to the sign hidden by the bushes, that does happen as stuff grows... But in 99% of all cases there are also signs at the entrances to the complex...
That might of been just one of the additional signs which are not required but are posted as general warnings.  

Now as to entering the vehicle, it is generally frowned upon as it opens all kinds of cans of worms up. But a tow driver can open cars to release brakes, or to secure a steering wheel to make it safer to tow...

As to who to go after for court, you can sue anyone you want but remember that the judge will throw out anyone who is not really responsible and I have seen ones where the bushes have covered up signs and they have been upheld as legal tows...


I was trying to find some specific rules in Illinois regarding "relocation" tows, but the laws have just changed and all my saved links have failed me. Sorry for the lack of specific laws, I am trying to find the new links.
