Towing Issues: Illegal towing in an HOA apartment complex, small claims court, storage fees

Hello,
My car was towed illegally because the apartment complex had confusing parking lot numbers. A tenant thought I had parked in his/her stall because of the confusing numbers. The car was towed, and is now incurring storage fees because I don't have enough money to get it out. The Home Owners Association has taken responsibility for the misleading numbers and will pay for the towing portion but not the storage fees. They won't give me any information of the person who towed my car due to privacy laws, but they were able to release the tenant's name because of the signature. I want to sue the person in small claims court for California but I am not able to get any information other than the tenant's name. Is the towing company or HOA responsible for the storage fees because I can prove that I was parked in my own stall? How do I get them to release the tenant's information?

Answer
You can request the information in writing, advising them that you intend to pursue legal action and if they wish to be excluded from it they need to provide you the information. If not you will have to get a subpoena for the information and may have to include the HOA and towing company.
