Towing Issues: towing in apartment complex, handicap placard, americans with disabilities act

I live in ca. I was involved in a bad accident that has left me disabled so I do have a handicap placard. The townhouse complex that I live in is owned by several different people, that were built before the ones that I live in. I have not been able to park in my drive way cause the way it set's with my disablities. There is 2 spaces right in front of my house in my front yard that is owned by someone else. My question is can I get towed from a residential parking spot with a handicap tag?

Well California has about a thousand laws regarding towing vehicles from private property, and you can find then on the California DMV web site.

BUT, the issue I see in your question is the one where there are several "PROPERTY OWNERS" in the complex. Now that means that the property owner, by law can have vehicles removed which do not belong in those spaces.  That is done by the property owner, manager or designated person signing an authorization form to have the vehicle removed, by the tow company.  

If the spaces are "DESIGNATED" or marked for specific units then you are really in trouble.


Now I really hate to say this, but the ADA (Americans with disabilities act) has some provisions in it which tend to apply at times, but having a handicapped tag is not a "GET FREE PARKING" ticket or device.

You still have to follow the rules, all the tag really does is "LEGALLY ALLOW YOU" to use designated and so marked restricted spaces.

Sorry for the bad news, but that is how it works out with parking.
