Towing Issues: Is the tow truck company responsible?, full coverage insurance, tow truck company

Question
I slid on some ice and jumped a curb. I called roadside assistance to see they get me unstuck and ended up having it towed due to some damage to the front left axle, spindle and control. However, when I brought the car to my mechanic I found out that both sides of one of the back controls arms were bent due to an improper hookup by the tow truck driver. Initially, the tow truck company said that they weren't responsible because it was an accident. All of the damage done because of the accident was in the front left tire area, nothing in the back. The operator didn't hook up the back until the car was on the flat bed. Now, they're willing to look at it. Are they responsible for the damage? And am I expecting too much in wanting them to pay for replacing both control arms?

Answer
In most cases regarding accidents tow operators try not to cause further damage when recovering a vehicle. Most police authorized accidents release a tow company from liability regarding additional damages due to difficulty of some recoveries. By not knowing how bad the recovery or  situation it's hard to say what would have been the best method for the recovery. Since you requested services from the motorclub my suggestion is contacting the motorclub. Explain the situation and what has been done so far. I am not trying to take responsibility from the tow company but can you or the mechanic say for sure that the rear control arms weren't already bent? I only mention this because depending how severe the damage is I have personally witnessed many vehicles that have been improperly towed before and the owner didn't know. We bring this type of damage to the attention of the vehicle owner before we hook to the vehicle to prevent this type of situation later. A experienced insurance adjuster can tell if it's recent or prior damage as well should you have full coverage insurance and making a claim for the accident.
