Towing Issues: my car was being towed, property management company, tow cars

QUESTION: It started this way,, my daughter lives in a private Condo which is gated. Some how the gate keeps getting broken and these tow trucks are now able to get in without being called. So I was helping her move to another location where she has bought a home. I parked in back of her gagrage area where you can to loading un unloading there. Yes that are is marked no parking , but here is the clause that is where they are asigned to wash their own cars. So if they are allowed to load and unload there wash there cars , why wasnt I allowd to help her load and unload my car there as well when no one called them?  (( property manangement didnt call them nor do they have the contract with then to towe any car / cars from that complex )) Also he was not a local towing company from my area use , Ive contacted the local police dept and they came out and imformed me that they  didnt have a contract with this company to towe in our city. This company is Code 4 Towing they have towed cars to many times injustly. Please help

ANSWER: It shouldn't make a big difference, but what state are you in? Most states private property impounds require a contract and a signed towing authorization from the person authorizing the tow. In addition may states require them to notify the local law enforcement agency any time a vehicle is towed without the owners consent. There are several areas for recourse here, it just depends on the state you are in. Did they actually tow your vehicle or just attempt to?

QUESTION:  To answer your question I live in Southern California  and I've asked the property management company did they hire this towing company to tow cars , their answer was No. and to your other question ,, no they didn't towed my car they attempted and he was making statements like I  do this all the time but let me call my boss maybe I can help you, (( like he was really trying to be my friend here , he was playing that roll of bad man verses good man thing here the way they play bad cop , good cop ))  Also the local Police department was never called .

I would start by reporting this company to the state attorney generals office. This sounds like predatory towing to me. I would also notify the property management and have them contact this towing company in person and advise them that they are not authorized to tow vehicles on the property.
