Towing Issues: car towed, 2006 chevrolet malibu, chevrolet malibu

QUESTION: My car was towed 12/2008.  I called the same day to go get my car and because it did not have tags, I was told I couldn't get my car.  I called again in March 2009 and June 2009.  When I called they said that the finance company had the car.  When I contacted the finance company they said they did not have the car.  Now the tow company is telling me the junked a 2006 Chevrolet Malibu.  What can I do?

First of all, I am wondering why you took 3 months to call back and then 6 months to call again after the first time.

Now the finance company, is something I am wondering about. Have you been making payments to them on it all this time????

Or did you not pay then at all.

And what was the car towed for, bad tags???

Why did you not get tags the next day or as soon as possible?

Each day it sits the bill goes up with daily storage fees.


Now as to the tow company junking the vehicle, I wonder was the vehicle registered to you, with the finance company listed as legal owner ???

Did you get any certified letters from the tow company regarding the vehicle being towed and up for lien sale for unpaid towing fees.

If you were not the registered owner as per DMV records then you would not of got the notices.

Someone somewhere had to be notified of the towing and pending sale of the vehicle.


Or the tow company did something which is illegal in most states...


Wish I could help more, but there are a ton of unanswered issues and questions here, and they also have to deal with what State this happened in.

Financially I was not doing good.  I had been a victim of identity theft more than once.  Just did not have the money, but when I had the money this is when they told me that the finance company had the car and I was still paying the note.

Yes, the finance company is listed as the legal owner.

Start with your state DMV, as they will be able to help you with the laws regarding towing of vehicles, and the lien process where they can legally dispose - sell your vehicle....

(AGAIN, I do not know where this happened, so I can not provide more specific information)

That would be the first place I would go to, then talk to the law enforcement agency which ordered the vehicle towed, unless it was towed from your apartment or condo complex then they would not really help.

The finance company has a lot of lawyers on staff usually, get them involved as it sounds like they were not notified.

Ask the tow company for proof that they notified the registered and legal owners of the vehicle that it was towed and pending sale...  Get copies of this information.

Then work with what ever DMV says should of happened and you might wind up in small claims court (depending the limits in your state) or regular court if the tow company violated the law.
