Towing Issues: Tow COmpany Kept my personal property, tow fees, newton mass

Hi,
My SUV broke down on the highway 95 North, I was ab;e to make it to the breakdown lane. I called AAA to send a tow truck, as I got off the phone with them the State Police pulled over and started yelling at me as I was trying to explain the situation, and that I had called AAA. He told me to cancel AAA towing because he had a tow truck on its way because I was in an active breakdown lane and he could not wait the time for AAA to come. I asked him if the tow company he has contacted was affiliated with AAA and he stated it was a local company and he did not know. I then cancelled AAA as he demanded repeatedly. The tow company that arrived was called Negoshian's Tow Company out of Newton, Mass. I then gave the tow company my address to where I wanted the truck towed and he told me "No, I have to tow it to the lot and it would be another fee to tow it to my house", I live in Middleboro, Mass. He wanted $185 to the garage and it was $200 to my house. Totalling $385. I didnt understand why he has to tow it to the lot at all, I could not afford 2 tow fees. He proceeded to take my truck to his yard and he told me when I had the money to come back. I told him I wouldnt have the money until next wk to get my truck. I had then asked for my property, which are expensive tools, that I had needed for work. He refused to releases my personal property with the exception of 1 tool bag and a car seat. I had called him on the following Tues, spoke to the Owner and told him I just got laid off, I had to wait a few wks for my Unemployment Benefits to start, he then told me to come up with $500 and he would give me my truck. I had once again asked for my personal property, my tools and my sons train collection, and he denied me once again, he stated he would not release my property until I paid the fee. So when I called him the following wk when I had the $500 he then told me it was now $900. He had never said he would charge me more for the truck, the $500 was firm. We had argued because he had not kept his word. So then a few months later I came up with the $900 I had called him and he now said he wanted $1800. How can this be right? We agreed on $500, then he raised it to $900, then $1800. And what about my personal property? All of this would be avoided if he originally towed me to my house, I had the money for the one tow. Can one be charged for two tows? Is this legal? Thank you

I would definitely pursue this. You have the right to contact a towing company of your choice unless they cannot make it within a reasonable time the officer should have let you use your towing service. You also have the right to have the vehicle towed anywhere you want. It does not have to go to their facility. The driver flat out lied to you. Unless your vehicle is towed by law enforcement you can decide where it goes. As for the fees going up that is common and the owner should have told you the fees accrue daily.I would contact AAA and let them know. I would also contact the DMV to see if they have a towing dispute form or process. I would recommend contacting the better business bureau and the Towing and Recovery Assoc of America to see if this towing company is a member. Let me know what you find out.
