Towing Issues: Tow Truck, tow truck operator, car port


Question
I am an Attorney in San Bernardino. I need a Tow Truck Operator that I could use as an Expert.  My clients were requested by a Tow Truck Operator to assist them in pushing their vehicle out of a car port before the tow when it was caused to run over my client. We contend that the tow truck operator should not have permitted my clients to assist in pushing their vehicle prior to the tow.  Thankyou.   Sanford Kassel

Not that it hasn't happened before, but when you are called as a towing operator it is your responsibility to remove and tow the vehicle. This would be like asking a tow truck operator to tell someone how to pull their vehicle with a chain which is stupid. I would say without a doubt that unfortunately the towing operator is at fault due to the fact that he asked your client to help. He should have been prepared to move the vehicle even if he had to winch the vehicle out of the carport with his cable(s). I have been involved in several cases that involved litigation for injuries.
