Towing Issues: Towing from Condominium Guest Parking, doral florida, hialeah police dept

On Sunday night we were visiting friends at their condo.  We parked in Guest Parking #3.  We went to leave aprox 1:30am - the car was gone.  Went to call the police thinking it was stolen,but saw a towing company's name on electronic gates, called there and asked if my vehicle was towed.  Yes,it was. When asked why, I was informed that Guest parking after midnight was not allowed on the property.  There is NO SIGN posted of hours allowed. (took pics). Our friends have lived there for 3 yrs and were also unaware.  It was called in at 11:58 to be towed they took it at 12:45 am.  I called the  Hialeah Police Dept. and they showed up, but said it was a "Civil matter" when I originally spoke to the dispatcher he asked me if I had knocked on the Mngrs. door - we did %26 no response.  He then sent out the Officer.  It cost $104.00 + several hours of lost sleep - got home w/car at 5:15 am 10/05/09.  Can I claim my $$ back from Condo Association.  There is no sign posted about allowed parking time in a CLEARLY MARKED GUEST PARKING SPACE. I tried calling "EL Pueblo De Vera Condo. Association" managed by Atlas Property Management in Doral Florida and have not received a response.  Mr. Joaquin Alvarez is suppose to respond... but I  doubt it.  It's not the $104.00 it's the PRINCIPAL.... there are alot of elderly people there as well as family who reside in the condo.  But if they have Company come over how do they know that CAN NOT stay parked in the GUEST PARKING after midnight... or their car will get towed.  Help.

I understand a Condo Assn can make their own rules But should a sign be posted about hours allowed in the Guest Parking Spaces.?
Is this considered an illegal tow???
PS I contacted a local attny he suggested small claims court.  I just don't want to waste more money.

The apartment or condo complex does have to post parking ordinances. It is required in all states and is mandatory before having vehicles towed. They must also have a signed request foir the towing agency. I would recommend filing a complaint with the Better Business Bureau and the local home or rental association. As for the fees, sure you could sue them in small claims court, but it would cost more to file it then you paid. A blanket towing authorization is not legal so I would ask to see a signed copy of the towing authorization.
