Towing Issues: Condo Tow, breach of contract, legal areas

Good day,

I live in NY in condo unit.   I am on the board, and we have had issues with owners not paying their condo fees.  If they don’t pay for 3 months we would like to block them from parking in our lot, and tow them if necessary.  We  do not own the parking spots, they are common area.

Can we do this – is this legal?

Well this gets into a few legal areas and that will be a big issue there.

It does depend on the "actual sale contract" or rental contract you have with the owners, and how the law will apply to your actually prohibiting them from parking in spaces.  

Common areas verses "ASSIGNED - OWNED" parking spaces and such will come to play...

Best answer is to talk to the lawyers who handle every thing else for the association, who will understand the local laws and such on "ownership fees and breach of contract"
