Towing Issues: Redemption of Personal Items, tow company, law enforcement agency

I recently had a friend involved in an accident who is hospitalized.  At present there is an outstanding tow bill of $300 and $45 in storage.  The tow lot will not allow her to claim her purse from the car until the total amount of the tow and storage is paid.  Is this legal?

YES, NO, and maybe.   Depends on the laws of the State and if the vehicle has "A HOLD" on it, which was placed by the law enforcement agency who had it towed.

Also is your friend the owner of the vehicle?

Remember the tow company has a duty to protect and preserve the property of the vehicle owner.

I can not really answer this with out knowing more information.
