Towing Issues: Towing in NH, motion alarms, life peace

I have a car that I use on the weekends right now.  I take the bus to work to be 'green' and living in NH winters can be rough.  I came out of my apartment today where the parking lot is shared with a business and noticed a note on my car.  Apparently my car alarm is going off and they will tow my car if this does not stop.  I park alongside my building, not even in their parking spaces.  I have one parking spot assigned to my apartment.  Do they have any right to tow my car because my alarm is going off?  I am not home during the day.  I work just like everyone else.  I have never had any problems with my car alarm, but the car is now 12 years old and it could be starting to fail.  When I am home on the weekends it has only gone off once and that was a couple of months ago.

Well, this is one of those weird gray areas of laws and towing issues.

First of all, there are generally "noise issues" which some vehicles are towed off with due to the alarm going off...  Quality of life, peace of the area kind of deal... Police departments do tow vehicles from time to time for alarms going off since they are "disturbing the peace" kind of issue.

Now if the vehicle is parked in your space which is designated parking for the apartments (not just first come first serve) then it might be a bit of a stretch for the business to have it towed.
Reason is that shared parking is always the big headache in parking lots. WHO ACTUALLY OWNS THE PARKING LOT is the question here and are there specific spaces for each.

Now as to the car alarm, I have to say that some of the older "motion alarms" do tend to get out of whack when they get older.
I used to work in Seattle near the airport and one person in the building next door had one of the older alarms and when the big jets came in (they were about 400 feet up and 500 feet south of us, the car alarm would go off each and every time the planes when over.

You might be able to get someone to either adjust the alarm sensitivity or something like that.


Hope this helps, but I have to say that some people do not know all the rules and regulations on towing vehicles from Private property and I can not really find many laws on that subject for New Hampshire. I know there are laws on this subject but I did not find any in a search online...
