Towing Issues: Fire lane private proparty apartment complex, tow yard, tow company

Question
QUESTION: My friends car was towed near across from trash dumpsters. There was a sign. The towing yard has a written agreement with the management company. This company is located 23 miles from where I live. It seems that even the sheriff station doesn't have any information for me but the website to the dmv. I have not been able to find much but read somewhere that there's a 10 mile radius law. When I called the yard and told them about it they said that that law was changed but the contract was signed prior to that law. I'm in California. The receipt mentions that it was dispatched, as apposed to what the yard told me "they were in the area". My manager said that they cruise the neighborhood. I asked my manager why they use this towing company and they said because they take pictures before towing. They charged one hour $160  for that and $40 per day. Are they braking any laws? Thank you.

ANSWER: Sounds like you are more upset over the drive or looking to put blame on someone else for the parking violation. Without further research, the tow company seems to have everything in place and the price seems spot on for private property towing. Since the tow company is the contracted tower whether in the area or dispatched the vehicle was still in violation, they have photograhic proof.

QUESTION: The civil liberty's have to remain intact. If my brother owns a tow yard and I manage the building I can contract him even though he's 50 miles away. Isn't there a limit to how far you can move the vehicle. The "without further research" isn't what I was looking for. My dad should be giving me your advice not an expert! Please can you find out if there's a clause for distance traveled in the state of California?

Answer
My "without further research" response was in part of the lack of other information that is needed to properly answer the question. Since I don't know the city or county in which the vehicle was towed there is no way to check local, city or county ordinances which could have a conflict or supercede the state code. At this time, I still can not properly answer the question.

The brother, family, by marriage scenario described would be illegal in some cities and states. The 50 mile limit you also described is exuberant but 20-30 miles could easily be within the city or county limits of some major cities and allowable in some cities and states. I can speculate but without knowing the exact facts that is all I'm doing. You can easily find the information by reviewing the state code and local ordinances online but does take time. You can also contact the state towing association for information. Another option is contacting a licensed attorney in that state for proper legal counsel.
