Well, one factor which might affect this issue is if the vehicle was towed by order of the police department verses from a private parking lot...

Each would have different issues as to releases on the vehicles.

In most cases the police ordered tow would require the "registered or legal owner" to go to the police station and get a written release form from the police authorizing the tow company to release the vehicle after all towing and storage fees are paid..

In the case of a tow from private property for illegal parking, well generally the tow company will release the vehicle to the legal or registered owner or its agent designated in writing which is also notarized...

The tow company will also have policies in place regarding releasing vehicles so that they "Cover their butt" in case they release the vehicle to the wrong person  (think divorces - separations)  

But I can not really tell you what will work or not as I do not know specific tow company policies or practices.
