Towing Issues: front bumper cracked durring towing, emergency roadside service, aaa emergency roadside service

I have AAA roadside, and I needed to be towed off the freeway.
I called AAA and told them that my 240sx was lowered (stock front and lowering springs in back) and had a body kit. A flat bed arrived and the driver got the lumber from his side box to load the car.  Both the driver and I noted no damage was done. When I picked my car up the front bumper was cracked, my friend said that the driver did it while off loading my car.  When I asked the towing company about it, they said that I did not provide lumber for the unloading of my car and "You signed a Hold Blameless form".

would i have no legal right to claim damages since i signed that form?

Well, speaking as a tow truck driver who used to do a lot of AAA calls over the years, I have to say that first of all AAA does not cover or did not cover "MODIFIED VEHICLES"... Reason being is that AAA emergency roadside service is designed to be used with the contracted tow company using "STANDARD AUTOMOTIVE SERVICING EQUIPMENT"

Special ramping, wood blocks and straps tend to cost more and are seldom used (read taking up space) on the tow trucks.

Now I take it that you were there when it was towed, but not where it was dropped off at... That will be an issue which can be hard to work around...
But was it dropped off at a repair shop, your friends house, your house or where ???

Reason that I ask, is that as a kind of "general rule" most repair shops will blame the tow truck for things which happen at their shops when it was towed in...
Thinks like getting on a lift or ramp platform can cause damages which look just like a tow truck doing the damage. Follow my thoughts here ?

Also low curbs in driveways as you are aware might cause the damage...

But as far as who to get damages from, well if the tow company did damage the vehicle, you can go after them in small claims court even with or without the "hold harmless damage" form...   I hate to say it but those really do not hold up as many court cases have proved.


Talk to the tow company more and see what can be worked out. Also if nothing else happens or you get no where, you can try contacting AAA about the damage and they might be able to mediate it with you and the tow company...
