Towing Issues: Towing company - owner auth to move car, storage fees, tow companies

Car wrecked on 4/23. Police called G. Towing Co. to move to their location.  I made claim with A. Ins. and asked them for their preferred body shops.  I picked and was told by A. Ins. to call G. Towing to release my car to H. Motor Co. on 4/23.  G. Towing "sat" on my car until 4/29 and has used various excuses about why it took so long.  A. Ins. said I had to release it, the towing co. says the opposite.  I am taking G. Towing to court to recover rental fees incurred.  I have documentation from G. Towing stating that I released it 4/23 adn that they delivered it on 4/29.  They would not willingly pay my rental for their error and charged a week's worth of storage fees to A. Ins.  Do I need to get written paper work on policy of release by owner from A. Ins. Co.?

Ah, good old legal questions which I hate trying to answer.

It sounds as if G did not really want to lose any money and held it for the excuses that you mentioned...

BUT I do want to say that when a vehicle is in the custody of a tow company they are liable for its safety and release to the proper people.  You would really hate for them to let someone else have your vehicle or get access to your belongings.

Now in defense of the tow company at times, paperwork gets misplaced and authorizations do not get recorded right away. It is worse with the busier and larger companies at times. You know that humans make mistakes and accidents happen...

As to suing "G Towing" well you can do that and I would get as much information, documentation and all the rules and regulations which apply to the tow companies which are in your state...

And since you declined to give me SPECIFIC INFORMATION, as to where this happened, I really can not help you with that part of the issue.

But an Internet search should come up with your towing regulations as written and created by your state, or the regulatory agency in charge of towing, or even the rules and regulations which are spelled out any any towing contract that the originating law enforcement agency (The ones that called for the tow at the accident scene) would have in place for the tow companies to follow...
