Towing Issues: car towed for alarm was going off, ordinance violation, noise ordinance

I read your other article about the same instance where a car got towed for
there alarm was going off.   I live in Cambridge, MA.  I don't or never knew i
had an alarm, and have only heard it once in 6 years.  I woke up on Sunday
morning to go to work and realized my car was gone.  After getting to work
and setting up, i called the police department to confirm my car was stolen.  I
was then told that it was towed because the alarm was going off.  It was
parked across from my house.  On top of having to pay $85 to get the car out
of the lot i also had a $300 ticket, stating that it was going off for longer
then 10 min.  Like i said it was parked across from my apartment.  The ticket
states my current address, and i did not get a knock on the door, and the
door bell never rang.  I have a dog that barks at every door bell, even on the
television.  I am just trying to find out the laws, and if this is a ticket i can
fight.  Well i am going to fight, just want to know if you can help me out with
any info on this predicament.  It has only made this alarm, which is also very
low volume, when someone was trying to get into the car with out using a
key.  My argument is that it could have been bumped or someone could of
tried to break in and after hearing this subtle alarm ran off.

Well if you heard the alarm once in 6 years then you most likely knew you had an alarm.

Now as to it being towed, that is generally a noise ordinance violation tow and yes a ticket is issued for it. $300.00 seems a bit steep to me, but that same ordinance covers the stereos that you can hear - feel coming down the road 2 blocks away due to the bass.

Now as to your alarm "VOLUME" well that leaves something to be desired at least to me. It is supposed to warn people off and also let you know that something has happened to the vehicle...  If you can see the vehicle you should be able to hear the alarm.

Now as to the officer trying to track you down, and knock on the door, well that would have to be discussed with them. But if they can hear the alarm going, and no one has responded to turn it off then they might of assumed that you were not home at that time.
Hard to guess what they were thinking, but we know what they did. They had it towed so that the neighbors did not have to hear it.

As to your dog barking at door bells, guess he does not know about alarms (kidding here). Most dogs howl with the alarms that I have been around.


Good luck on the fighting of the ticket and the tow, but remember that the tow company did what the police requested and that was after the police found a violation of a law.
