Towing Issues: towing, wrong place at the wrong time, storage charges

I had a car parked at my brother's house because it ran hot and needed to be parked. I live approx 30mi. from my brother and was on my way to pick up my car except when I arrived found my car was gone! My brother said that a wrecker towed my car along with his from his house against his will. I called the officer about the tow only to be told that my brother was being evicted from his property and my car was removed. I was charged a fee and everything to retrieve my vehicle. Is this legal when I had nothing or no knowlege of my brothers situation? This happened in Houston,TX.

In most evictions the property owner must give notice to the tenant weeks or months before the tenant is required to leave the property. In many cases a law enforcement officer is usually present to keep the peace as both the landlord/property owner and tenant are together or at least in close proximity. If your vehicle happened to be there on the eviction date then the property owner has the right to have the vehicle removed. The tow would be supervised or authorized by the officer as well. It's a case of your car being at the wrong place at the wrong time. You will be responsible for the towing and storage charges as well.
