Towing Issues: trespassing, criminal trespass, criminal harassment

Question
my neighbor filed a complaint of criminal trespass and criminal harassment against me at Newark municipal court. She claimed I parked my car in her property without her consent. We share the same driveway and no fence between us. the truth is this lady has been bothering me and my family. whenever she complained that my car is on her property we remove it right away. her tenants block the driveway most of the time and we don't say nothing. We never had this kind of experience with  the former owners before she purchased this property. We are scared maybe this woman is bent on giving us a criminal record. I have never been to jail in my life. please tell me what to do. Because of this we are putting our house in the market for sale.

Answer
A shared driveway is the worst thing in the world to have.  Someone always feels that it should be only for them...  (yes I have lived where we shared driveways)

Now as to what to do, I really can not answer that as it is more a legal question for a lawyer, but I kind of believe that if this came to court, the judge might laugh and throw it out, since the shared driveway issue will be a 50-50 property ownership issue.

Now as to "HER PROPERTY" I am not sure about it, but you might consider building a fence or a wall where your property lines are so that it is cut and dry where the "responsibility and ownership" is.

And since she is always complaining, yet she allows her tenants to violate the law and trespass then you can always "use fair play" and go after them and complain also...

Courts are full of law cases and the counter cases which always seem to apply.

Good luck and sorry to hear that you are going to sell the house to resolve the issue.
