Towing Issues: SUV accidentally dropped while being towed, kelly blue book, kelly blue book value


Question
Two months ago I used AAA to hire a local towing company after my 1997
Landcruiser overheated. It took a very long time for the tow truck driver (who
said he was really the dispatcher but it was a "slow day") to "hook" up my car
(I'd had it towed in the past w/o difficulty). He placed it on "dolly's" and
apparently attached something to my tow hitch (that we use to pull our boat).
We were going roughly 20 mph when I heard a loud noise, I looked in the
side
view mirror (I was passenger in the tow truck) and the dolly's and my car had
been dropped and were fading in the distance. There were long skid marks
(my car was in park) and the dolly's were in pieces all over the road. Thank
goodness no one was behind us as they easily could have been killed. I have
filed a complaint/claim with AAA and have heard nothing even after I called
several times. I was told by two mechanics that this type of accident could
cause damage to the transmission and other parts of the car that are not
readily apparent. I am wondering what your thoughts are about
responsibility/compensation. I "dumped" the car to the highest bidder at my
Toyota dealership b/c I didn't want to drive my kids around or pull our boat
in a car w/ "potential" problems. I got $750 for it and the Kelly Blue book
value is close to $9,000. I couldn't in good conscience sell it on Craigs List
w/o mentioning the "accident" and potential for problems. I am seeking the
difference in Blue Book value and what I was paid for the car, plus the cost of
the ripped tow hitch. Please evaluate situation.

Your first course of action should have been taking the car to an ASE mechanic, preferably a Toyota dealership, to have the vehicle inspected for possible damage. Then you should have taken that estimate back to the tow company and AAA for reimbursement. Now that you have sold the vehicle and it is out of your care and custody, there is no way to prove absolutely what damage or if any damage was done at the time of the initial incident. You chose to sell the vehicle and agreed to the selling price regardless of past history. Since so much time has passed and you no longer own the vehicle, in my opinion I think it will be difficult to get either AAA or the tow company to follow through with any kind of reimbursement.
