Towing Issues: Legality of Towing From Als Towing, dunn loring metro, state statues

Hi,

What are the legal issues concerning this situation?

My car was recently towed from a private parking lot across the street from Dunn Loring metro. There was a sign at the entrance of the parking lot indicating private parking and towing is enforced but then there was reserved parking spaces closed to the building and empty unmarked spaces next to the other building where I had my business appointment. I was not sure if this parking space was allocated for this office so I left my car for less than 10 minutes to check. While returning, the towing guy from Al’s Towing was in the process of loading my car for towing. In fact, he had just gotten into my car to release the gear and brake, and has not started driving away yet. I asked him to put my car back and offered to pay him at the scene if he would unload my car and let me move it. He refused, gave me a business card with a phone # to call to get instructions to get my car. I called the towing company immediately and the supervisor demanded that I come with exact cash of $125 to get my car.

Don’t they have to report this to the police prior to towing? How would I get this information?
Can they demand cash only?

I had found out that they have to release my car if I am at the scene. They are allowed to charge $25 max. What is the consequences for this violation? Do you know of any other violations?

I have phone records and witnesses to back up my claim.

You probably had a parking violation and seems that you are not arguing that. In my opinion the driver should have done a drop fee if the vehicle was not physically loaded/hooked yet. If the hooks, chains or cable were attached to the vehicle then it is considered a hooked/loaded vehicle. Most state statues make towing companies accept another form of payment other than cash. There can be some terms and conditions but if you had a major credit card in your name (with approval) and you could prove (vehicle registration in your name and your driver's permit) that was your car I would think the towing company is in violation for accepting payments. Having a witness through the whole event helps your claim. Research your state statues, hope this helps and good luck
