Towing Issues: Tow due to Unlicensed Driver, california drivers license, valid drivers license


Question
Situation is this:
- Pulled over for suspected talking on cell w/out handsfree in bay area California (San Mateo county)
- Have an expired California drivers license but a valid Washington State drivers license
- Presented the CHP officer with valid WA state license
- Evidently pulled expired license on the computer
- Gave a ticket for driving w/out a license
- Had car towed

Question:
Is it possible to file a claim against the state or county for the towing fee's when I clearly had a valid drivers license.

Hi Mark, I understand what you are getting at but what state do you live in? Since I don't know exactly your residency or how the vehicle is registered here are some things to take into account. If you are non military, inactive military and have a vehicle registered, tagged, insured in CA and or have residency in CA then you are required to have a CA driver's license. If you truly have a valid WA license at the time of offense, then get in touch with WA for verified proof and go to court and dispute the charge. With that said I'm sure the CA judge will review your residency, vehicle registration, insurance requirements, your driving record and why you haven't surrendered your CA driver's license.
