Towing Issues: Towing Damage who is liable?, tow truck driver, legal recourse

My vehicle was towed from an accident site and damage was caused by the towing. The tow truck driver ackowledged the damage was caused by him and gave us his business card. His company says they won't pay for the damages. They say, when you get towed you assume the risk of damage to your vehicle when it is being towed, even if the driver says nothing about assumed risk and or more damage to the already damaged vehicle. What is my legal recourse for reimbursement.

I honestly wish that 'the assumed risk of damage' were the case. Our profession is vulnerable to damage claims that aren't always accurate. To put it nicely. I guess there are many towers that deserve a kharma-tic repayment of that sort.

This being a civil matter, and assuming that the cost of the damage done is under $1000, your only recourse is small claims court. The peoples court called me over something like this last month.
