Towing Issues: Towing from Apartment complex, apartment complexes, agreement contract

Question
I live in California and I drove my fiance home from the hospital last weekend after he had surgery and stayed with him overnight as right now he needs medical care.  My car has been parked in the complex many times, but never over night.  I parked in a guest parking spot and the next morning recieved a warning notice on my car that stated I had violated the weekly alloted guest parking hours.  There was also a note that said your car will be towed on _______ and listed a time 12 hours later. But no where on the paper was there listed what the weekly alloted guest parking hours are. I searched the complex for signs that stated guest parking hours or any information about towing, but there isn't one.  I got rides from people for a few days, and then three days later, I brought my car back.  It had only been parked there for four hours before another notice was put on my car.  If there is no sign posted about guest parking hours, is it legal for an apartment complex to have a car towed?  I have heard of other people who live there who've had similar problems and actually did get towed, but as my fiance needs care and there is no street parking anywhere near the complex, I may not have a choice right now. Unfortunately, there is no main office at the complex itself, or I'd just ask them, but I've just been leaving messages at their office number and have been unable to get a hold of anyone.

Thanks,

Answer
Hi Michelle, I am assuming your fiance is a paying tenant in the apartment complex which he would have a rental agreement/contract. Most apartment complexes have rules and limits for guest parking. In most cases he would have to go to the rental office for a guest pass/parking permit for extended stays. Some apartments complexes have a max. hourly limit which sounds like your case. If he can not find the rental office or there is not one on site, there has to be someone in charge of the complex. There might be a resident manager or the maintence supervisor. There is ALWAYS eyes and ears watching over a rental property. If he doesn't know ask the neighbors, look thur the rental contract. As for the notices on your car, this is a sign of a professional company giving you the chance to do the right thing. Most towing companies record the make, model, license plate numbers for possible future violations and repeat offenders. Just moving the car from different parking spaces or coming back and forth is looked at as a shell game. Having no marked towing signs anywhere at any entrance to the complex is odd as it is law in many states. The violation sticker didn't have any other information as to who tagged the vehicle? At this time I suggest you don't park there until you have permission or authorized. Don't wait until your car gets towed and try to prove your point after the fact. The towing company or management company have been very lenient. Just remember the saying in baseball, three strikes and your out. You have been tagged twice. Hope this helps if not just ask.
